1. Acceptance and scope
These Terms of Use are an agreement between you and Waffer, Inc. (doing business as “Teaflask”, “we”, “us”) and govern your access to and use of the teaflask.com website and its content (the “Site”). By accessing the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.
These terms cover the Site only. Use of the Teaflask service — the dashboard at app.teaflask.com, our APIs, the assistant our customers embed in their products, and the help centers we host for them — is governed by the Customer Agreement, which you accept when you create an account. If these Terms of Use conflict with the Customer Agreement with respect to the service, the Customer Agreement controls. Our Privacy Policy and Cookie & Storage Policy describe how we handle data on the Site.
2. Site content and intellectual property
The Site and its content — text, graphics, logos, product names, designs, and software — are owned by Waffer, Inc. or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to access and view the Site for your own informational and business purposes. “Teaflask” and our logos are trademarks of Waffer, Inc.; nothing on the Site grants a license to use them.
Content on the Site is provided for general information about Teaflask. It may describe features that are in development, and it is not a commitment, representation, or warranty about current or future functionality. It is also not legal, financial, or other professional advice.
3. Acceptable use
When using the Site, you will not:
- violate any applicable law or regulation;
- interfere with or disrupt the Site, or attempt to gain unauthorized access to any of our systems, accounts, or data;
- probe, scan, or test the vulnerability of the Site other than through a coordinated disclosure to security@teaflask.com;
- misrepresent your affiliation with Teaflask, or frame or mirror the Site in a way that implies our endorsement;
- use the Site to transmit malware or any harmful code.
Reading and indexing the Site — including by search engines and AI systems — is welcome; see our llms.txt.
4. Feedback
If you send us feedback, ideas, or suggestions about the Site or our products, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation. We never require feedback, and this section does not apply to data you entrust to the service under the Customer Agreement.
5. Third-party links
The Site may link to third-party websites and resources. We do not control them and are not responsible for their content or practices; a link is not an endorsement. Your use of third-party sites is at your own risk and subject to their terms.
6. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAFFER, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
8. Changes to the Site and these terms
We may change or discontinue any part of the Site at any time. We may also revise these Terms of Use; the current version, with its effective date, will always be posted at this address, and changes apply from the date they are posted. Your continued use of the Site after a change means you accept the revised terms.
9. Governing law
These Terms of Use are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of these Terms of Use or the Site, and each party consents to their jurisdiction.
